#1 Australian nationals and those who hold any type of long-term residency in Australia (the “applicant”) are eligible to apply for a UK spouse visa to enter and live in the UK with their UK partner (the “sponsor”) for an initial period of 33 months.

Please be aware this article only discusses applicants making a spouse visa application from outside the UK.

Applicants applying from inside the United Kingdom should instead read our FLR M visa guidance.

“Can we apply from inside the UK, or must we apply from outside the UK?”

Only applicants who hold a long-term UK visa (valid for more than six months) which is not a UK visitor visa (or leave as a non-visa national) are eligible to apply from within the UK.

Applicants without such a visa will have to apply outside the UK.

For example, Tyler, an Australian national, is currently in the UK as a tourist. Since Australians are non-visa nationals (they can enter the UK as a visitor without applying for a UK visitor visa before entry), he is in the UK with leave as a non-visa national. Tyler will have to return to Australia and submit an out-of-country application there.

The exception to this are applicants who are in the UK on a fiancé or proposed civil partnership visa – who can apply from inside the UK.


#2 A UK spouse visa will permit the Australian applicant to work in the UK.

Applicants in the UK on a spouse visa are entitled to work in the UK.

If you and your partner are not yet married and are wondering whether to apply for a UK spouse visa or a UK fiance visa, this may be a factor to consider as applicants holding a UK fiancé(e) visa do not have the right to work in the UK.

Instead, the fiancé(e) visa applicant will only be permitted to work in the UK once they have been granted the subsequent FLR(M) visa (which is typically applied for before the expiration of the six-month UK fiancé(e) visa).


#3 Indefinite Leave to Remain (ILR) and British Citizenship can be obtained via the UK spouse visa route.

Applicants who have lived for five years in the UK with a partner on the spouse visa route can usually apply for Indefinite Leave to Remain (ILR).

Therefore, applicants who meet all the spouse visa UK requirements in 2024 and continue to do so should be able to apply for Indefinite Leave to Remain after five years.

The exception is for those applicants who are granted leave on the 10-year route to settlement rather than the 5-year route. Such applicants will have to live in the UK with their partner for ten years before obtaining Indefinite Leave to Remain.

What is the UK spouse visa fee/cost in Australia in 2024? 

A UK spouse visa application from Australia costs 3,568 Australian Dollars. This figure is based on the conversion rate at the time of writing (1 GBP/1.91 Australian Dollars) and the Home Office application fee of £1,846.

UK spouse visa applicants from Australia must also pay the Immigration Health Surcharge (IHS).

The IHS fee amounts to 5,930 Australian Dollars.  This figure is based on the conversion rate at the time of writing and the IHS fee of £3,105.

The amount paid will depend on the exchange rate used – as discussed in our UK spouse visa fees in 2024 article. Consequently, applicants must pay between 5% more or less than the exchange rate listed on popular currency exchange websites.

Applicants may also need to consider another additional cost if they choose to pay for an immigration lawyer to help with the application.

How do we book the visa centre appointment in Australia?

The first step is to submit the online application by paying the Home Office fees on the spouse visa online application form in 2024.

After submitting the online application form, applicants will be redirected to the VFS website.

Once on the VFS website, applicants can book an appointment at one of the VFS locations below and pay for any additional, optional services they may choose (such as the priority service).

How do we submit the supporting documents from Australia?

Applicants usually have the following options when submitting their supporting documents.

#1 Post the documents to a specified address in the UK.

Applicants can typically post their documents to a VFS scanning hub in Birmingham, in the UK, where the documents will be scanned. VFS charges an additional fee for this service.

Documents can also be delivered in person to the scanning hub and two other VFS offices in London and Edinburgh.

#2 Upload the documentation via the self-upload portal on the VFS website.

Applicants can normally self-upload their supporting documents from their home computers.

#3 Submit the documents at the visa centre in Australia or the UK using the document scanning assistance service.

What are the UK spouse visa requirements from Australia in 2024?

To meet the UK spouse visa requirements from Australia in 2024, applicants must:

The specific UK spouse visa documents required for applicants from Australia depend on how an applicant meets each of the requirements.

It should first be noted that applicants submitting their applications from Australia do not currently have to complete a Tuberculosis (TB) test as part of the spouse visa application.

The English Language Requirements For Spouse Visa Applications Made From Australia in 2024

Fortunately, applicants from Australia will automatically meet the English language requirement if they hold Australian nationality. The only evidence required is a copy of a current Australian passport.

Those applicants applying from Australia who do not hold Australian nationality (e.g., applicants who are in Australia on a work visa) can meet the English requirement in several ways. These are:

#1 Non-Australian Applicants from Australia who also have a majority English-speaking nationality can automatically meet the spouse visa English language requirement – if their nationality is on a specified list.

The nationalities on the specified list are Antigua and Barbuda, Australia, the Bahamas, Barbados, Belize, the British Overseas Territories, Canada, Dominica, Grenada, Guyana, Ireland, Jamaica, Malta, New Zealand, St Kitts and Nevis, St Lucia, St Vincent and the Grenadines, Trinidad and Tobago and the USA.


#2 Applicants aged 65 or over when the online application is submitted are exempt from the English language requirement.


#3 Sitting an English language test.

Applicants from Australia can satisfy the English language requirement by sitting a Secure English Language Test (SELT).

Applicants planning to take an English test should be aware of the following:

i) Applicants must book a test at least A1 level of the CEFR.

Please note, as discussed in our UK spouse visa English test requirements 2024 article, applicants can opt to take a test at a higher level (either A2 or B1 level) because these tests can normally be used to meet the English requirement in later applications to extend leave to remain in the UK, for Indefinite Leave to Remain and for British citizenship.

Additionally, the English test must be on the list of Home Office-approved Secure English language tests in 2024.

#4 Applicants with a disability (a mental or physical condition) preventing them from meeting the English language requirement (or have exceptional circumstances) could be exempt from the English language requirement.

#5 A Bachelor’s, Master’s, or PhD degree taught in English can also be used to meet the English language requirement.

Those applicants who hold a Bachelor’s, Master’s or PhD degree certificate from an educational institution (usually a university) in the UK can normally use their qualification to meet the English language requirement.

Those applicants with a Bachelor’s, Master’s or PhD degree certificate from an educational institution in Australia or any other country outside the UK, taught in English, will need to submit their certificate alongside documentation from ECCTIS (previously UK NARIC) stating:

  • The qualification was taught or researched in English at or above A1 level (depending on whether the qualification was awarded in a majority English-speaking country or not – excluding Canada); and
  • The qualification meets or exceeds the recognised standard of a Bachelor’s degree in the UK.

As the ECCTIS procedure includes paying fees, applicants often decide to sit an English language test as they find it a more convenient and straightforward process.

The Relationship Requirements

In summary, the relationship requirements that must be met are:

#1 The applicant and sponsor must have a genuine and subsisting relationship.

Home Office caseworkers will consider the application, the factors of a genuine and subsisting relationship and supporting documentation as a whole before deciding whether they think the relationship is genuine and subsisting.


#2 The applicant must be married, in a civil partnership or have lived with someone for two years who is British, has settled status, has refugee leave or humanitarian protection or has settled status under the EU settlement scheme.

Alternatively, the partner may be someone from the EU, Switzerland, Norway, Iceland or Liechtenstein with pre-settled status under the EU Settlement Scheme (& started living in the UK before 1 January 2021);

Applicants applying as married or civil partners must show their marriage or civil partnership is lawfully recognised in the country where the marriage or civil partnership took place.

Arranged marriages usually are deemed acceptable as long as the Home Office caseworker considers the applicant and sponsor are in a genuine and subsisting relationship.

Applicants who are engaged to be married or plan to enter into a civil partnership in the UK can apply for a UK fiancé visa or a proposed civil partnership visa.


#3 The applicant and sponsor must be 18 or older on the date of application.


#4 Any previous legally recognised relationships either the applicant or sponsor have had must have broken down permanently (unless the relationship falls within a small number of exceptions).


#5 The applicant and sponsor must have met in person.


#6 The applicant and sponsor must intend to live together permanently in the UK.

The Adequate Accommodation Requirements

Applicants must provide evidence they have adequate accommodation available for themselves and their family unit, their partner and any other family members when submitting their online application.

Please note that the accommodation cannot be prospective. Therefore, applicants must provide evidence suitable accommodation is already available when the supporting documentation is submitted.

Please also be aware that the accommodation cannot be classed as ‘overcrowded’. Accommodation is overcrowded based on the number of rooms available as sleeping accommodation and the number of persons that will be living in the property:

The Suitability Requirements

Only a minority of applicants from Australia will be affected by the suitability requirement. With this being said, it is essential to be aware of these requirements.

You should also be aware an application may be refused if the applicant has failed to pay outstanding NHS charges amounting to at least £500 or litigation costs awarded to the Home Office.

Can we book the visa centre appointment in Australia before submitting the online application?

No. The visa centre appointment in Australia can only be booked after you have submitted the application (which is done by paying the Home Office fees).

At what date do the requirements have to be satisfied?

The relevant date is normally the date that you pay the Home Office fees on the online application (this is known as the “date of application”). Contrary to what some partners might assume, the date at which the applicant attends the visa centre in Australia is not normally relevant.

What is the most common reason for refusals for UK spouse visa applications from Australia?

The most common reason for refusals is the financial requirement. You are required to not only satisfy the minimum income threshold (which is currently £29,000), but you are also required to submit documents which comply with document-specific Immigration Rules.
