What will you get if you apply for a UK spouse visa from Brazil?

#1 Brazilian nationals and people who hold any type of long-term residency in Brazil (“applicants”) are eligible to apply for a UK spouse visa to enter and stay in the UK with their UK partner (“sponsors”) for 33 months initially.

Please note this information is for applicants making a UK spouse visa application from outside the UK.

Applicants applying from inside the United Kingdom should read our FLR M visa guidance.

Applications can only be made from inside the UK if the applicant already holds a long-term UK visa (valid for more than six months) which is not a visitor visa (or leave as a non-visa national).

An exception here is those in the UK on a UK fiance visa in 2024 who can submit the application from inside the UK.

Without such a visa, applicants must make an out-of-country application from outside the UK.

#2 A UK spouse visa will permit the applicant from Brazil to work in the UK.

Applicants holding a UK spouse visa are entitled to work in the UK.

This is an advantage over a UK fiance visa, which does not provide permission to work.

#3 Indefinite Leave to Remain (ILR) and British Citizenship can be obtained via the UK spouse visa route.

Applicants on the spouse visa route who live for five years in the UK with their partner will typically be able to apply for Indefinite Leave to Remain (ILR).

Therefore, if an applicant submits an application that meets all the spouse visa UK requirements in 2024, they should be able to apply for ILR after five years if they continue to satisfy the requirements.

The exception is if an applicant is granted leave on the 10-year route to ILR rather than the 5-year route. Such applicants must live in the UK with their partner for ten years before obtaining ILR.

If the ILR application is approved, applicants will have lawful immigration status in their own right. Therefore, they will no longer rely on their partner (the sponsor) to live in the UK.


What is the UK spouse visa fee/cost in Brazil in 2024?

The UK spouse visa/fee cost in Brazil in 2024 is 11,531 Brazilian Real. This figure is based on the conversion rate at the time of writing (1 GBP/ 6.25 Brazilian Real) and the Home Office application fee of £1,846.

UK spouse visa applicants from Brazil must also pay the Immigration Health Surcharge (IHS). The IHS fee amounts to 19,406 Brazilian Real.  This figure is based on the conversion rate at the time of writing and the IHS fee of £3,105.

Can I apply for the UK spouse visa inside the UK instead of Brazil?

As we talked about earlier, if an applicant holds a visa granted for more than six months (& is not a visitor visa), they will typically be able to apply from inside the UK.

If not, applicants who are Brazilian nationals or those legally resident in Brazil (such as, for example, those holding a work and not a visitor visa), will have to apply from outside the UK (either from Brazil or their other country of nationality or residence).

Please note this does not apply to applicants in the UK on a fiancé or proposed civil partnership visa – who can apply from inside the UK.


How do we book the visa centre appointment in Brazil?

Firstly, applicants must complete the spouse visa online application form in 2024.

After submitting the online application form (when the Home Office fees are paid), the applicant will be redirected to the VFS website.

Once on the VFS website, applicants can book an appointment at one of the locations above and pay for any additional, optional services they may choose.


How do we submit the supporting documents from Brazil?

There usually are the following different options for submitting supporting documents.

#1 Post the documents to a specified address in the UK.

Applicants can post their supporting documentation to a VFS scanning hub at an address in Birmingham to be scanned. There is an additional fee for this service.


#2 Submit the documents at the visa centre in Brazil or the UK using the document scanning service.

A member of VFS staff may be available to scan the documents for an additional fee.


#3 Upload the documentation via the self-upload portal on the VFS website.

Supporting documents can usually be self-uploaded from an applicant’s home computer – we now generally recommend this.

What are the UK spouse visa requirements from Brazil in 2024?

The UK spouse visa requirements from Brazil in 2024 are:

First, applicants who are Brazilian residents do not normally have to complete a Tuberculosis (TB) test to show they do not have TB when applying for a spouse visa. In other words, Brazil is not a country that is currently on the list of TB countries.

Brazilian residents will only have to take a TB test if they are living in one of the listed countries or if they have lived in one of the listed countries in the 6 months before applying.

Applicants from Brazil can satisfy the English language requirement in several different ways.

#1 An applicant from Brazil with a majority English-speaking nationality can automatically meet the spouse visa English language requirement – as long as the nationality is on a specified list.

Applicants need to hold one of the nationalities on the list, which are: Antigua and Barbuda, Australia, the Bahamas, Barbados, Belize, the British Overseas Territories, Canada, Dominica, Grenada, Guyana, Ireland, Jamaica, Malta, New Zealand, St Kitts and Nevis, St Lucia, St Vincent and the Grenadines, Trinidad and Tobago & the USA.

Applicants only require a copy of their passport evidencing nationality of one of these countries to satisfy the English language requirement.


#2 Applicants aged 65 or over when the online application is submitted are exempt from the English language requirement.


#3 By sitting an English language test.

Most applicants from Brazil choose this option.

Applicants should be aware of the following if they are planning to take an English test:

i) Applicants choosing to sit an English test must book a test which is at least A1 level of the CEFR.

However, as discussed in our UK spouse visa English test requirements 2024, applicants can consider taking a test at a higher level (either A2 or B1 level) as these tests can usually be relied on in later applications to extend leave to remain in the UK, for Indefinite Leave to Remain and for British citizenship.

ii) The test must be on the list of Home Office approved Secure English language tests in 2024.

#4 Applicants with a disability (a mental or physical condition) which prevents them from meeting the English language requirement (or there are exceptional circumstances) could be exempt from the English language requirement.

#5 A degree, Master’s or PhD taught in English can also be used to meet the English language requirement.

Applicants with a Bachelor’s, Master’s or PhD degree certificate from an educational institution (usually a university) in the UK can normally use this to meet the English language requirement.

Applicants with a Bachelor’s, Master’s or PhD degree certificate from an educational institution in Brazil or another country other than the UK, which was taught in English, will need to submit the certificate alongside documentation from ECCTIS (previously UK NARIC) stating:

  • The qualification was taught or researched in English at or above A1 level; and
  • The qualification meets or exceeds the recognised standard of a Bachelor’s degree in the UK.

The ECCTIS process includes fees and applicants often choose to sit an English language test as they tend to find this more convenient and straightforward.

The Adequate Accommodation Requirement

Applicants must provide evidence that adequate accommodation is available for themselves, their sponsor and any other family members living at the same address when the online application is submitted.

Further, as discussed in part 3 of our 3-part free video series, accommodation cannot be prospective.

Therefore, applicants must provide evidence that there is sufficient accommodation already in place when the supporting documentation is submitted.

Please also note the accommodation cannot be classed as ‘overcrowded’.


Requirement 4

The Relationship requirements

The main relationship requirements that must be met are:

#1 The applicant must be married, in a civil partnership or have lived with someone for two years who is British, has settled status, has refugee leave or humanitarian protection or has settled status under the EU settlement scheme.

Alternatively, the partner may be a person from the EU, Switzerland, Norway, Iceland or Liechtenstein with pre-settled status under the EU Settlement Scheme (& started living in the UK before 1 January 2021);

Applicants applying as married or civil partners must have entered into a marriage or civil partnership that is lawfully recognised in the country in which the marriage or civil partnership took place.

If the applicant is in an arranged marriage, as long as the Home Office caseworker deems the applicant and sponsor to be in a genuine and subsisting relationship, the relationship requirement is likely to be met.

Please note that applicants who are engaged to be married or plan to enter into a civil partnership in the UK can apply for a UK fiancé visa or a proposed civil partnership visa.


#2 The applicant and sponsor must have a genuine and subsisting relationship.

The Home Office caseworker will consider the application and supporting documentation as a whole before making a subjective assessment of whether the relationship is genuine and subsisting.

Home Office caseworkers are instructed to consider cultural considerations when assessing whether the genuine and subsisting relationship requirement is satisfied.


#3 The applicant and sponsor must intend to live together permanently in the UK.


#4 Any previously legally recognised relationships of either the applicant or sponsor must have broken down permanently, unless the relationship falls within a small number of exceptions.


#5 The applicant and sponsor must have met in person.


#6 The applicant and sponsor must be 18 or older when the online application is submitted.

The Suitability requirements

The suitability requirement will only apply to a minority of spouse visa applicants from Brazil, but the requirement must be met, so applicants should take time to read the details.

Applicants must also be aware that an application may be refused if they have failed to pay litigation costs awarded to the Home Office or if there are outstanding NHS charges amounting to at least £500.


Frequently Asked Questions

When will the documents need to prove that the Immigration Rules are met?

The relevant date that the Immigration Rules need to be met is ordinarily the date that the online application is submitted (by paying the Home Office fees). You will not be expected to prove that the Immigration Rules are met on the date that the applicant attends the visa centre appointment.

Is the financial requirement the most common reason for refused UK spouse visa applications from Brazil?

Yes. This is because the financial requirements will require you to not only show that you earn enough (or have enough cash savings), but they will also require you to provide documents that are compliant with document-specific Immigration Rules.

Can the applicant leave Brazil after the application has been submitted but before the application has been decided?

Applicants can normally leave Brazil after applying but before the application has been decided if they opt for the “keep my passport” service. They must, however, return to Brazil to re-submit and then collect their passport.
